New Regulations to rein in Realty 

Having grown into a massive sector, it is but natural that the real estate sector has to cope up with the some unscrupulous
elements damaging the image of the Realty. But recently there are appearing certain developments which could reform and redeem it. If they when put into practice, could cleanse up the system, transforming it to be a major driver of growth. The
recent Supreme Court judgment stating that immovable property can only be transferred via a registered Deed of Conveyance should plug loopholes that buyers and sellers use to transfer property using Power of Attorney and other devices,
thereby bypassing taxes. And the draft Real Estate (Regulation & Development) Bill to be introduced in Parliament's winter session will-if implemented properly-finally afford buyers some security.

It aims to set up state-level regulatory authorities, making it mandatory for developers to register with these bodies and submit project details. There'll be punitive costs for straying from the submitted details and a host of other measures. When both these moves concurrently get effected, it could go a long way in bringing about a clean-up that the real estate sector so badly needs.

But it is true that these alone are not enough. The other side of the equation must be handled as well. The two most urgent requirements are to rationalize stamp duty and scrap the Rent Control Act everywhere. The former has been pinpointed by Prime Minister Mr. Manmohan Singh as one of the prime causes for the glut of black money in the real estate sector under- the-table deals thrive when legitimate processes come with excessive costs attached. Yet, there's been no relief on this front. Cities like Mumbai are glaring examples wherein the Rent Control Act has done a great deal to worsen the demand-supply imbalance. It has added to artificial shortage created by builders' unrealistically high price
points. The net result, combined with interest rate hikes, is a real estate sector rapidly being priced out of the reach of all but a narrow band of wealthy people. India's growing middle class has been an economic asset and the feel-good story of the
decade, but there are increasingly few options in the country's m in urban centres for it. For those who require low-cost housing, the situation is even worse.
