Tenant and lease agreement

Before finalizing the tenant agreement and accepting the terms and conditions from the both side, both the parties should understand each other’s terms and facts on the property. This can avoid the future possible disputes on the property and the terms and conditions.

From the landlord side he must ensure the tenant’s position and the financial background to get the payments properly from him. It is necessary to ask about the financial stats and the income source as well as the business or work etc.

From the tenant side he or she must confirm the property is under mortgage and the tenure of the mortgage and the possible issues arising on the default. The tenant should confirm that the bank has allowed the renting of the property. In usual terms the banks are not allowed to rent out the property they mortgaged or atleast the landlord has to obtain prior approval from the bank to rent out the property. if the landlord did not get the approval from the bank and failed to repay the mortgage amount to the bank then the bank will takeover the property without any notice. Then the tenant will lose the deposited money and the tenant right.

Following are the important guideline the tenant agreement should have in paper.

The renting period

The date of commencement and the date of end of the tenant.

Whether a notice to be served to the tenant, to vacate the property, before the renting period ends.

Whether the tenant has the option to renew the tenant, before the ending of the tenant period should be mentioned.

Whether there is a break clause is applied or not to make the agreement end if there is some unwanted and unapproved changes takes place in the property or from the landlord side if any issues raised that affects the tenant.

If the tenant is given the opportunity to renew the tenant, the rate of rent after the renewal should be mentioned in the agreement. If it can be decided at the end of the tenant period then it has to be mentioned on which date the rent will be fixed and from what date it comes to effect.

The tenant agreement should contain the following details.

Rental amount

Rent to be paid on monthly or quarterly or yearly

Whether the rent is inclusive of management fees, parking fees, government taxes and other rates to be paid by the tenant.

Duration of the rent free period if any should be mentioned and the responsible person to pay the rent has to be mentioned in the agreement.

Payment method should be mentioned.

If the rent is not paid on time would it attract any penalties or not.

All these particulars with other relevant details for the legal purposes should be added.


Deposits and expenses other than rent

The amount of deposit for the rental security to be paid has to be mentioned in the agreement otherwise the deposit cannot be used to cover the default rental payment if any.

Upon the termination of the agreement and the tenant the fees and other amounts to be paid has to be deducted from the deposit without the prior consent of the tenant has to give receipt for the deducted amount by the property owner or landlord.

Usually no interest will be paid on the deposit paid by the tenant. In other cases the tenant can ask the landlord to accept a bank guarantee in place of the deposit amount. On failure of the payable of the rent the bank will pay the rent and charge the tenant with their rules and regulations.

 Government rent, property tax, utility expenses, management fees, building maintenance expenses, electricity gas and water charges, repairs and painting expenses, open area or common area maintenance fees and the damages rectification expenses from fire or any other cause on the usage of the property are to be borne by whom is to be clearly mentioned in the agreement.

The drainage maintenance and the water tank maintenance, and the wooden parts maintenance are to be taken care and it has to be decided who will pay the expenses and it has to be clearly mentioned in the agreement.
