In the space starved Mumbai, Redevelopment of society buildings seems to be only way to house the increasing population. The state government has sanctioned extra F S I for the redevelopments. But it is not as easy as it seems. The co-operative society must take note of the procedures and comply with them. Also they have to be extra careful when selecting a developer.

While finalizing the builder the office bearers of the society must ensure the solvency of the builder by asking for the solvencycertificate and income tax returns for the last three years. But first, all the members must agree to the proposal of redevelopment and must be ready to shift to alternate accommodation during the construction of the building. It is observed that builders pay 15 months rent to members for alternate accommodation, which may not be sufficient. 

There are a number of reasons for this viz., the building may not be ready to occupy by that time or the occupation certificate from the Municipal Corporation is delayed, etc. It is observed that the builders do not pay rent for the alternate accommodation beyond 15 months resulting the member has to pay from his own pocket. So the best thing is to take bank guarantee from the builder to pay the rent till the member is given the agreedaccommodation in the newly redeveloped building.

Before proceeding, a development agreement has to be made between the builder/developer and register it. The society should also appoint its own architect in addition to the architect of the builder. The builder will not introduce any additional financial partner nor will the builder transfer his rights without the written consent of the society and no financial liability of any nature whatsoever will be on the society. Possession of premises to non members should not be given unless the possession of premises is given by the builder to each and every existing member of the society. 

Additional area if any, over and above in the present occupation, to be given free of cost to each member plus extra corpus money. The builder'sarchitect should finalize in consultation with society's architect thebuildings design. The maximum area that would be constructed by the builder should be specified in the agreement. As per the BMC rules, society office, gymnasium, health club are not included in F S I and should be constructed by the builder at his cost. It is advisable for the society to appoint its own legal advisor to draft and prepare the development agreement to be executed with the builder, in such a manner that the interest of the society are properly safeguarded. 

It is society's responsibility to have clear and marketable title and possess conveyance of the property along with P R card reflecting society's ownership therein. The redevelopment of society building require all the legal documents in the society's name. The list of do's and don'ts may be long but to observe it by the society is must.
